Terms and Conditions

These terms and conditions govern your use of this website and any order you place with KemsetUSA, LLC ("Kemset", "we", "us"). By placing an order you agree to these terms. Please read them carefully.

Orders

Submitting an order through this website is an offer to purchase the listed products. An order is not accepted until we confirm it and issue an invoice. We may decline or cancel an order, including where a product is unavailable or a price has been listed in error.

Pricing and payment

Prices are shown in US dollars and exclude shipping and applicable taxes unless stated otherwise. We do not currently collect payment through this website. After you place an order we contact you with an invoice covering the goods, shipping, and any taxes due. Goods are dispatched once the invoice is settled in accordance with the payment terms stated on it.

Shipping

We ship within the United States only. Shipping charges are calculated from the delivery address you provide and are included on your invoice. Whether an address is residential or a business or company address may affect the shipping charge, so please select the correct type when placing your order. Delivery estimates are not guaranteed.

Products

Our specialised building materials are intended for use by competent trades and applicators. Product descriptions, specification sheets, and safety data sheets are provided for guidance. You are responsible for confirming that a product is suitable for your intended use and for following the application and safety instructions supplied with it.

Returns

Because many of our products are mixed, tinted, or sold in quantities prepared for a specific job, returns are accepted only for unopened goods in resalable condition and must be arranged with us in advance. Contact sales@kemset.com to request a return.

Warranties and liability

Products are warranted to meet their published specifications at the time of dispatch. To the fullest extent permitted by law, we exclude all other warranties, express or implied, and our total liability arising from any order is limited to the price paid for the goods concerned. We are not liable for indirect or consequential loss, or for loss arising from incorrect storage, handling, or application.

Governing law

These terms are governed by the laws of the State of Texas, and the courts of Texas have exclusive jurisdiction over any dispute arising from them.
